ISECTION - A
PERMANENT ACCESS ROAD
A - 1 SCOPE
The work under this section shall Include the supply of all
labour, plant and materials, and the performance of all work,
necessary for the construction and maintenance of a permanent
access road and other structures such as culverts, as required 
by the engineer and as specified herein.
A - 2 DESCRIPTION OF WORK
The permanent access road commences from the town of Alaba Kulito 
the Contractor shall be responsible for planing and improving the
existing dry weather road as approved by the engineers the Cont
ractor shall supply and maintain ail necessary signs, barricades
and distinctive marking required during the Contract period to
ensure the safety of vehicles for protection of life and property 
without additional cost to the employer. The permanent access
road provided for maintainanace purpose shall be based on the
route and extent shown on the drawing and as approved bv the
engineer.
A - 3 MEASUREMENT AND PAYMENT
Measurement for payment under items A - 1 and A - 2 will be
made of the centerline length, in kilometres, of the permanent
access road measured to the nearest 10 m constructed.
Payment under the above items will be made at the unit rate per kilometre stated  in  the bill of quantities for permanent access road construction including excavation, supply & placing of
subgrade fill and surface topping, ditches and disposal of waste material,2
SECTION - B
CLEARING AND GRUBBING
B - 1 SCOPE
The work uncfer this section shall include the supply of all
labour, plant and materials, and the performance of all work necessary for clearing and grubbing the sites for ti.o construction of permanent structures, permanent access road , borrow,quarry disposal and other miscelaneous area. The clearing ior the contractors camp, temproary facilities, and temporary access road are not included, and the clearing of these areas shall be at the Contractor’s own cost.
B - 2 GENERAL
The engineer will define the limits of clearing and grubbing required for the permanent works. Prior to commencing clearing of borrow areas, quarry sites and disposal areas, the Contractor shall submit his plans, showing the extent of clearing required 
for approval.

B - 3 DISPOSAL OF MATERIAL
All debris reoultinj from clearing and grubbing operations
shall be removed from the area and shall be disposed by any
one method as approved by the engineer.
No material from the cleaning and grubbing operations shall be placed or buried in areas within the project limits other than those designated by the engineer as disposal areas.
The contractor shall be responsible for any damage done by fire resulting from the v^rk under this item.
B - 4 MEASUREMENT AND PAYMENT
Measurement for payment for clearing and grubbing will be made of the number of hectares cleared and grubbed as specified herein and as required by the engineer, measured as the projection onto a horizontal plane.

COFFERDAMS AND UNWATERING
C - 1 SCOPE

for the construction and maintenance of the cofferdams and the
subsequent removal of cofferdams as shown on the drawing, as
required by engineer and as specified herein.
C - 2 GENERAL
The cofferdam and  unwatering  work  shall be performed  in  stages to permit construction  of permanent structure as shown  on  the cons truction schedule drawing or as approved by the engineer.
C - 3 MATERIALS
Material for impervious zone 7 of the cofferdam shall consist of silty clay obtained from the designated impervious borrow area of other excavation areas approved by the engineer. The impervious material sb* 11 have a plasticity index between 15 and 45. The
grain size distribution ol uhe impervious material shall fall within the following limits.5
C - 4 INITIAL, UNWATERING
Prior to commencing the unwatering operation, the contractor shall submit details of his proposed pumping arrangements for the engineer's approval. The engineer reserves the right to require additional pumping capability or to require the contractor to perform additional sealing work.
C - 5 LONG TERM UNWATERING
When the inflow of water in the area between the cofferdam has been reduced to a satisfactory rate, the contractor shall submit

SECTION - D
COMMON EXCAVATION
D - 1 Scope
The work to be done under this section shall include the supply 
of all labour, plant and materials, and the performance of all
work necessary to carry out the excavation of common material
as shown on the drawing; as required by the engineer and as spe
cified herein.
The work  shall also  include the transportation  and  permanent disposal of ail excavated  materials which  arc unsuitable for ~Mb.si.iux.tlGn.
D - 2 DEFINITIONS
Common material shall be defined as all materials other than solid masses of rock, and shall include wet materials* Svlluj weathered rock rippable by a bulldozer, stumps, roots, peat
bog, and other buried organic debris, as well as individual
rock fragments, boulders and detached rock blocks having a volume of 1 m3 or less.
The removal of rock fragments, boulders and detached rock blocks encountered in the common excavation which are larger than Im is covered uodj?,r rock excavation.
D - 3 GENE RAL

Prior to the commencement of the work, the contractor shall submit, for review by the engineer5 dotails of his proposed methods, schedule, and sequence of operations, to be followed for the excavation to be sa out as specified herein.

additional cost to the employer and may be required to be backfilled with acceptable material and compacted at no additional cost co the employer.

flows entfMng or adjacent to the excavation shall be controlled.
The engineer may require Che stockpiling of suitable excavated material, and utilization of the material shall be subject to review by the engineer, location for stockfjXing shall be as required by the engineer.
The disposed or stockpiled material which will remain permanently exposed shall be finished to a stable slope.
D - 4 MEASUREMENT AND PAYMENT
Measurement for payment will be made of the volume in cubic metres, of common material coveted, as measured in place, from the surface of the natural ground or the surface exposed by pr-vlona exc^Lion or clearing to the lines and grades shown on the drawings or to rock or cs squired by the engineer.

SECTION - F
ROCK EXCAVATION
E - 1 SCOPE
The work under this section shall include, the supply of all
labour, plant and materials, and the performance of all work
necessary for the excavation of rock from the site of the
main dam, appraoch channel, discharge channel, low level outlet
and spillway as shown on the drawing and as required by the
engineer.
The work shall include the transportation and permanent disposal
of excavated rock which is unsuitable for construction, and the transportation of acceptable rock to locations where it can either
be used as part of temporary or permanent structures or stockpilied 
in-readiness for future use, as required by the engineer.
DEFINITION
E — 2 Rock excavation is the removal and disposal of bedrock, wherever found, which can be removed only by drilling and blasting. The term rock shall include rock fragments, boulders and detached blocks having a volume larger than 1 m .

Controlled perimeter blasting includes, trim blasting and prespl - Lttmg, trim blasting consists of removing separately a protective
zone of rock, approximetly 1.0 m thick. This will generally be used to produce finished grade for the spillway section or as
required by the engineer.

Presplitting  consists of drilling  a single row of closely  spaced holes, loading  all the holes uniformly  and  lightly, stemming  the
entire length of the holes and then firing them simultaneously.
E - 4 ’-OCR EXCAVATION
The contractor shall prepare and submit, in writing co the engineer
his overall plan of proposed methods and sequence of excavation using controlled perimeter blasting techniques. The engineer reseivfclthe
right to reject the proposed plan if, in his opinion undesirable
damage to permanent rock surface or existing structures would result
from performing the blasting as proposed.
Following the acceptance by the engineer of the contractor's blasting 
plan the contractor shall prepare and submit a detailed plan showing 
the location depth and area of each blast, diameter, spacing, pattern 
and inclination of blast holes, type, strength, amount, column load 
and distribution of explosives to be used, per holes per delay per blast.
No drilling or blasting shall be carried out in areas for which the plan 
has not been accepted by the engineer.
If the plan previously accepted does not produce good results, the contractor shall submit a revised plan to the engineer before proceeding with futber blasting.
E - 5 UTILIZATION AND DISPOSAL
The utilization of excavated rock shall be subjected to review by the engineer. Location for stockpiling of excavated rock shall be as accepted by the engineer. Rock unsuitable for stockpiling shall be disposed in 
locations accepted by the engineer.

Payment under this item will be made at the unit rate per metre stated in the bill of quantities for presplitting of rock surface complete in every respect and as specified herein.
Drilling for presplitting and trim blasting outside   the neat line
of excavation will not be measured

SECTION - F
CONCRETE
F - 1 SCOPE
The work under this section shall include the supply of all
labour, plant and materials, and the performance of all work necessary for supplying and placing concrete in the works, as shown on the drawings, as required by the engineer and as specified herein.
F - 2 DEFINITION
Cement shall mean normal pqrtland cement as specifiecd herein unless otherwise defined.
Water/cement ratio shall mean the ratio of the weight of water contained in a freshly mixed batch of concrete to the weight
of cement contained in the same batch. th£ Veight of water shall mean that weight in the batch which free to combine with the

cement, and does not include water absorbed by aggregate. The content of cement shall mean the number of kilograms of cement per cubic metre of concrete in place.
F - 3 COMPOSITION OF CONCRETE
Concrete shall be composed of cement, fine aggregate, course aggregate, water and permitted admixture as specified herein and as required by the engineer.
F - 4 SAMPLING AND TESTING CEMENT AT SITE
The contractor shall provide access cement samples, as the engineer may

F - 5 STORAGE OF CEMENT
Cement shall be placed in waterproof storage at the site, provision 
for the prevention of absorption of moisture shall be to the satis faction of the engineer.
The contractor shall arrange that the reserves of approved cement
are adequate to meet the requirement for the project without delay 
in schedule. These resrves shall be adequate to allow time for the engineer to test each shipment of cement before such cement is incor prated in the works.
F - 6 AGGREGATE GENERAL
The contractor may obtain aggregate from naturally occuring granular deposits, from sound rock obtained from excavation, or from quarry areas, all as approved by the engineer.
The contractor shall carry out all washing, classifying, screening, rescreening, crushing, blending or other processing of aggregates necessary to meet the requirements of this specification.
Control tests and analysis of aggregate may be carried out by the engineer at any time. The contractor shall provide and transport all necessary test samples to the laboratory as specified and as
required by the engineer.

F - 7 FINE AGGREGATE
The engineer shall have the right to test for fineness modulus after
the material is delivered into the batching plant, and the contractor
shall make necessary adjustments to conform to the requirements of this specification.
Course aggregate may be rejected if, when tested for specific grevity, the specific gravity              is less than 2.6.

The     mixing,     handling,     scoring     and     rates     of     application     of     all     admixture shall be in accordance with the manufactures recommendations.
F - 10 CONCRETE MIX DESIGN
The engineer will determine, generally the mix proportions for the designated classes of concrete to be used in* work. The engineer will specify the mix proportions for each concrete class and reserves
the right to change these proportions from time to
time as he may deem15

Field tests for concrete quality control will be performed by the
engineer, the contrator shall provide any assistance deemed necessary 
by the engineer.
F - 11 BATCHING GENERAL
The contractor shall provide at the site, subject to the approval
nf the engineer, dependable, and accurately controlled batching and 
mixing plant capable or bupp»yihf. ''oncrete in accordance with this specification.
F - 12 MEASUREMENT AND TOLERANCE
Water, cement, admixtures, fine aggregate and each size of course aggregate shall be sighed separately and not cumulatively.
In general slump will be 5 cm, slumps greater than 5 cm are perndrted 
only for pours in locations of difficult areas or for heavely reinforced sections, as approved by the engineer, in no case shall the slump exeed
10 cm.
For mixtures of lm  capacity or less the mixing of each batch shall continue for not less than 1^ min. but not more than 5 min 
when mixing air entrained concrete for mixers of larger capacity the minimum mixing time shall be increased by 15 seconds for each additional \ m3.

F - 13 PLACING GENERAL
Prior to placing concrete in any location, the contractor shall provide the engineer with written notice, that the preparation 
of formwork, reinforcing steel, or other embeded items for the pour; has been completed. This notice shall be signed by all formen responsible for the above mentioned work.

G - 1 SCOPE
The work to be done under this section shall include the supply

G - 2 DEFINITIONS
Formwork    or    form    means    a    fabricated    mould    into    which    concrete    is    placed. False work means the structural support and bracing for formwork.
G -3 FALSE WORK
The contractor shall have responsibility for the design, construction 
and maintainance of all falseswork required for the works, all false
work shall be designed to withstand safely^ all live and dead loads

G - 4 MATERIAL FOR FOILWORK
All materials used in the formwork constru tion shall be of adequate
strength and quality for their intended purpose and shall be satis-
factory to the engineer.
Lumber shall^sound, straight, free from warp, decay and loose knots
and shall be dressed smooth.
where plywood is used, it shall be nonwarping, non wrinkling and manufactured with special waterproof glues.
Reuse of forms and form lumber will be allowed provided that they 
are thoroughly cleaned and repaired and capable of producing the
finish required for the concrete.
The contractor shall not use damaged forms or forms which have deteriorated through usage.
G - 5 DESIGN AND ERECTION OF FORM WORK
The contractor shall design, construct, erect and maintain all
forms necessary to confine the concrete without loss of mortar,
and produce finished surfaces which are within the tolerances
specified.
Forms for concrete against which backifill is to be placed or which 
will not be exposed to view may be constructed of smooth tight
boards.
Forms for concrete exposed to flow of water or exposed to view shall
be constructed of steel or plywood which is smooth and free from defects with matched and sanded joints to give a uniform pattern over the entire area. Formed surfaces shall be uniform and free from offsets, fins
and other surface defect.

grout. Large openings and cavities shall be filled with dental concrete
The exposed surfaces of dental concrete and slush grout shall be gently contoured to conform with the surrounding bedrock surface geometry, n large cavities of depression the engineer may require backfilling with Impervious fill material using power tampers if necessary.
Grout for slush grouting shall consist of cement and sand throughly mixed in proportion of 1 part cement to 2 parts sand by volume, with sufficient water to produce a mixture which can poured and broomed into racks and fractures in the^urface of the rock to fill completely all
open joints and crevices. The grout shall be mixed in a mechanical mixer for atleast 2 minutes and shall be applied to the surface and broomed into cracks and fractures within 45 minutes /K-5

L-1 Scope
The work to be done under this item shall comprise the supply of all labour, plant and material, and the performance of all work necessary to excavate, load,transport, dump, spread and compact as required fill material for t e main dam as shown

L-2 General
The contractor shall obtain construction materials from excavation areas, from natural deposits or from borrow and quarry areas suggested below. The contractor shall provide the engineer' with plans and schedules of borrowing, with sa mples and laboratory test results sufficiently in advance of construction to allow the engineer sufficient time for exami nation and further testing.

Adjustment of moisture content shall be made in such a way

material. Wetting or drying, blending and discing shall be
performed on the dam prior to compaction if required by the
engineer.
Impervious Zone 1
Material  for  the  impervious  zone  1  shall  consist  of  silty  clay, obtained from the designated borrow area, or materials from
•other sources and approved by the engineer.39
The stock piling of filter zone 2 materials shall be at the
areas selected for stockpiling and shall be approved by the engineer.
The contractor shall provide the engineer, typical samples and grain size test results at least 15 days prior to commencing placement of these materials. All sources of material-outside the project area shall be subject to the approval of the- engineer.
I.-5     Transition Zone 3
The  material  shall  consist  of  crushed  rock  from  quarry  areas  or selected rock from the structure excavation and shall comprise
hard,   durable,   nondegrading   particles   free   from   organic   matter, flat or elongated particles, dirt & clay.

L-8 Quarry Operations & Borrow areas
The contractor shall carry out the exploitation of the quarry 
or borrow area in such a manner that the maximum quantity 
of acceptable material for each zone of the dam becomes available at its specified size, gradation and moisture
content. Equipment used by the contractor for processing, blending & scarifying materials shall be subject to the app roval of the engineer.
The contractor shall excavate test trenchs in any portion
of the quarries or borrow areas where and when required by the engineer to evaluate the quality and quantity of available rock & soil types.
The quarry or borrow area shall be stripped of materials which are not acceptable as fill, stripped material shall
be hauled to the disposal area.
Adequate measures shall be implemented to provide adequate drainage of surface water and to prevent ponding and infiltration in the borrow mate, is'Upon completion of quarry and borrow operations, slopes n the area shall be trimmed to safe and stable slopes.
L-9 Spreading and Compacting;General
Fill materials shall be spread in approximately horizontal layers 
of uniform thickness. If necessary discing, HARROWING or
other approved means shall be employed to break up the material and
to blend it before compaction.
Care shall be taken to prevent the fills from contamination by 
mixing with adjacent materials. Materials which have become cont
aminated shall be removed and replaced where required by the
engineer.
Fill material shall be placed and spread in d.rection parallel
to the axis of the dam, except as otherwise permitted by the
engineer.
If in the opinion of the engineer, the surface of the fill is too
dry or too smooth to bond properly with the layer of material to
be placed there on, it shall be moistened and/or worked with a disc,
scarifier or other suitable equipment.
The  layer  within  a  zone  shall  be  compacted  in  stripes  with  compaction coverage OVERLAPING not less titan 50 cm.
Those portions of fill material adjacent to abutments and to irre gularities in the rock surface whieh, in the opinion of the engineer cannot be properly compacted with specified compactor units, shall be placed in layers not exceeding 10 cm.- 43 -
With particle size not less than 50 mm and at a moisture content
on the wet side of optimum moisture content.
Final acceptance of fill material will be made only after it has 
been dumped, spread and compacted in place. The engineer may reject
fill in the borrow area in the transporting vehicle, or in place.
The thickness of fill layers in zone i within the dam shall not
exceed 20 cm before compaction.
The placement moisture content for zone 1 fill shall be maintained between a value of 1 percent below and 2 percent above the optimum moisture content.
Fill for zone 1 shall be free from rock fragments greater than 150mm in maximum dimensions.if larger than 150mm they shall be removed at the source.
Zone 1 material shall be compacted to a dry density at least equal to the maximum obtained by test.
L - 10 Filter and Transition Zone 2 & 3
Filter and transition material, zone 2 & 3 shall be spread
in layers not exceeding 40 cm. in thickness before compacting.
In no case shall the thickness of the filter zone be less than that shown on the drawings.
Each layer of filter and transition zone material shall be compacted with at least six complete coverages of the vibrat r smooth steel drum roller. Filter material shall be damp before compaction and wetted as required by the engineerL - 11 Zone 4 Dumped Rockfill
The maximum particle size perm tted in the fill shall not
exceed 450 mm.
L - 12 Zone 5 Dumped Riprap
Placing of riprap shall be performed so that segregation
of size does not occur. Riprap shall be dumped and levelled and dressed to ensure the completed riprap is stable with no tendency to slide, and that there will be no unreasonably large voids. The riprap shall oe placed in layers not more than 150 mm. The dumping of r.prap at the top of the slopes and pushing it into place down the slope will not be permitted
The engineer will consider acceptance of a method of hand placing the riprap if it conforms to the following.

Before proceeding with any of the work specified in
this section the contractor shall furnish the construction
sequence and material utilization scheme he proposes.
a) Equipment
Vibratory rollers shall have a total weight of
approximately ten tonnes, with at least 90» of the
weight transmitted to the ground through a single
smooth drum when the roller is standing in level
position hitched to the towing vehicle. The diameter
of the drum shall be approximately 1.5 mts. and
width >80m.
The roller shall be towed at a speed not exceeding
4km / hr.
b)   Tamping Rollers
Tamping rollers Shall be used for compacting impervious fill. Each drum of the roller shall have an outside diameter of not less than 1.5 mts. and shall not be less than 1.2 M. or more than 1.8 mts. in length.
On level surface the space between the two drums shall not be less than 30 cm or more than 3S cm. One tamping foot shall be provided on the drum for at least 100 square inch (62.5 cm ) of drum surface. The length
of earth tamping foot from the outside surface of drum shall not be less than 22.5 cm (9"). The c/s area of each tamping foot shall not be more than 10 square inches at a place normal to the axis of the shaft six

inches from the drum surface.

The weight of the roller when fully loaded shall not be less than 4,000 lb (1818 kg) per foot length of drum.
The loading used shall be as required to obtain the desired compaction. During the operation of rolling the contractor siidl' keep the space between the tamping feet clear of matericls which would impair the effectiveness of the tanning i u 11 c r s.
Sprinkling___ Equipment
Sprinkling equipment shall consist of tank trucks, pressure distributers or other equipment designed to apply water uniformly and in controlled quantities to variable width
of surface.
Hand Operated Mechanical Tampers
Hand operated mechanical tampers, which shall weigh not less than 400 kg (static) and shall be capable of producing impacts of 3000kg at 2000 vib/min, in areas considered in accessible by the engineer, for the use of such power tampers, the engineer will permit the use of power tampers of approved equivalent. The contractor shall ensure that adequate spare parts and standby equipment are available at short notice in the event of break downs during
construction.

M - 1 SCOPE
The work under this section shall include the supply of all
labour, plant and material, and the performance of all work 
necessary for supplying, shaping and laying dry ruble masonry 
and mortar rubble masonry for the main dam over flow spilway 
section as shown on the drawings, as required by the engineer
and as specified herein.
M - 2 MATERIALS

M - 3 SIZE OF STONE
Individual  stone  shall  have  a  thickness  of  not  less  than  150  mm and a width of not less than 1 • 5 times the thickness.
M - 4 SHAPING OF STONE
The stone shall be roughly squared on joints, beds and faces-

M - 5 MIXING MORTAR
The mortar for mortar rubble masonry shall be hand or

machine mixed,
as may be required by the engineer.
In the preparation of hand mixed mortal the sand and cement sljall be thoroughly mixed together in a clean,
tight mortar box until the mixture is of Uniform color
after which clean water shall be added in such quantity
as to form a stiff plastic mass. Machine mixed mortar shall
be prepared in an approved mixer and shall be mixed not less than 2 minutes.mortar shall be used within 45 minutes after mixing.retenpering of mortar will not be permitted.
M - 6 LAYING STONE FOR MORTAR RUBBLE MASONRY
Mortar rubble masonry shall be to the lines and g^Ats shown on the drawing and as required by the engineer.
The   bottom   or   foundation   courses   shall be  compose:*  of  large  selected  stones,  and  all  courses shall  be  laid  on  prepared  foundation  beds  approved  bv rhe engineer.
Each stone shall becleancd and throughly saturated with water before being set and the bed which is to receive
it shall be clean and well moistened.             All stones shall be well bedded in freshly made mortar. The mortar joints shall be full,and the stones carefully settled in place beforfi
the mortar is sec.
Joints and beds shall have an average /38r
pointed shall be prepared for pointing by racking them out
to a depth of not less than 50 mm. before the mortar has set.
The face surfaces of stones shall not be smeared with the mortar forced out of the joints or that used in pointing.
The vertical joints in each course»shall breaX with those in adjoining courses by at least 150 run.
If any stone is moved or bro/ken, the stone shall be ta’en up, the mortar thoroughly cleared form be and joints, and the stone reset
in fresh mortar.
h - 7 POINTING
Joints not pointed at the time the stone is laid shall be throughly met with clean water and filled with mortar. The mortar shall be well driven into the joints and finished with an approved pointing tool.
The masonry work shall be kept wet while pointing is being done and in hot or dry weather, the pointed masonry shall be protected trum the sun and kept wet for a period of atleast three days after completion «•
After the pointing is completed and the mortar set, the mortar rubble masonry work shall bfcUaroughly cleaned and left in a neat and work manlike condition.

CONDITIONS Of' CONTRACT
rart 1 - General Conditions
definitions
In the Contract (as hereinafter defined) the following words
and experessions shall have the meanings hereby assigned to 
them except where the context otherwise requires
(a)        'Employer' means the hater Resources Development Authority The Provisional Military Government of Socialist Ethiopia.
(b)         'Contractor* moans the person or persons firm or company whose tender has been accepted by the Employer and in — eludes the Conti’actor  s personal representatives, successo. and permitted assigns, The phrase Prime Contractor shall
be deemed to mean the Contractor,
(c)      ’Engineer’ means the Engineer designated in Part II, 
Special Conditions, or other Engineer appointed from time
to time by the Employer and notified in writing to the Contractor to act as Engineer for the purposes of the Contract in place of the Engineer so designated,
(d)      ’Engineer’s Representative’ means any resident engirxaer
or assistant of the Engineer or any clerk of works
appointed from time to time by tho Employer or tho Engineer to perform tho duties set forth in Clause
Part II, Special Conditions, whose authority shall be notified in ’writing to the Contractor by tho Engineer.
U) ’Contract’ means the Conditions of Contract, Specification Drawings priced Bill of Quantities Schedule of Rates and Prices (if any) Tender and Contract Agreement,
(
' ’Contract Price’ means the sum named in the Tender
Subject to such additions thereto or deductions therefrom as  may be made under the provisions hereinafter contained
of(g)        «Substantial Completion* means that the project as a whole, including changes and additional works authorised by the Employer or the Engineer, is at least ninety-eight per cent (98%) completed and that all items of work aro sufficiently advanced to permit operation of the works for the purposes intended,
(h) ’Completion1 for the purposes of Clause 5 hereof means
’Substantial Completion’.
(i)         ’Site* means the lands and other places provided by the Employer for the purposes of the Contract.
(j)         ’Works’ means the works to be executed in accordance with the Contract,
SPECIFICATION AND JRAv’INGS
The Contractor shall keep on the Site one copy of the drawings and specifications which shall be at all reasonable times available for inspection and use by the Engineer and the Engineer’s Representative and by any other person authorised by the Engineer. Anything mentioned in the specifications and not shown on the drawings, or shown on the Drawings and not mentioned in the specifications, the Specifications shall govern. In any case of discrepancy either in the figures, in 
the Drawings, the Priced Bill of Quantities or in the Specifications, the matter shall be promptly submitted to the Engineer or the Engineer’s Representative, who shall promptly make a determination in writing♦ Any adjustment by the Contractor without this determination shall bo at his own 
r isk and expense. The Engineer shall furnish from time to tine such detail drawings and other information as may be considered necessary, unless otherwise provided3
CHANGES
(a) The Engineer may at my time, by a written order, and without notice to the sureties, make changes in the drawings and/
or Specifications of this Contract and within the general scope thereof. If such changes cause an increase or decrease in the amount due under this Contract, or in the txine required for its performance, an equitable adjustment shall be made and the Contract shall be modified in writing accordingly^ Any claim of the Contractor for adjustment^ under this Clause raus *"• be made in writing within thirty 
(30) days from the date of receipt by the Contractor of
the notification of change $ provided, however, that the Engineer, if he determines that the facts justify such action, may receive and consider, and adjust any such claim made at any time prior to the date of final settlement of the Contract, If the parties fail to agree upon the adjustment to be made, the dispute shall be determined as provided in Clause 5^ and of these General conditions entitled ’Disputes’, But nothing provided in this Clause shall excuse the Contractor from proceeding- with the prosecution of the work as changed. Except as otherwise herein provided, no charge for any extra work or materials will be allowed,
(b) All proposals for changes in the work shall be submitted by the Contractor in a lump sum amount,
In  considering  proposals for changes involving  added  works omitted  works,  or any  combination  thereof,  chock  estimates in detail will be made by the Engineer, utilising unit
prices         where         specified         or         agreed         upon, arriving at equitable adjustments.

works installed, with each proposal for a change involving increase or decrease in the amount of the Contract Price, 
the Contractor shall submit separately an itemized breakdown that will include, but not to be limited to, the followings-

small tools, incidental costs and general office expenses.
(h)        The percentages for overhead, profit and Commission to be allowed may vary according to the nature, extent and complexity of the work involved, but in no case shall exceed the following subject to the provision that higher percentages for overheads may be allowed, if established by the practice of the trade,

CHANGED CONDITIONS
If during the execution of the Warks the Contractor
encounters physical conditions or artificial pbstructisns
which could not have been reasonably forseert by an experienced Contractor or- if the Contractor encounters-
any changes in physical conditions differing significantly from the information indicated on plans, drawings, specifications end bill of quantities of the Works the Contractor shall forthwith give written notice thereof
.to-the Engineer and if the Engineer finds that such 
physical conditions or artificial obstructions could not
have been reasonably forseen or differ t^ a aign-t-p-i r^nt degree from the information indicated fcn plans, drawings, specifications, bill of quantities of the Works then the Engineer shall certify and the Iknpleyer Shall pay the additional expense to which the Contractor shall have been, put by reason of such physical conditions and artificial

a)   Complying with any instruction which the Engineer may issue to the Contractor in connection there with;
b)   any proper and reasonable measures which the Contractor may take in the absence of specific instructions from the Epgineer as a result of fi encountering such conditions and obstructions. ./'*6 -
5.
Contract or any extension thereof or fails to complete
said work within such time, the Contractor snail forfeit
his right to proceed with rhe Work or such part of the
Work as to which there has been delay after written notice from the Employer and the Employer may cause the Work'to be prosecuted to completion, by and through the performance by the sureties of their obligations under the Tender
and Performance Bond, or otherwise, and the Contractor and his sureties shall be liable to t.ie Employer for any excess co3t to the Employer occasioned thereby, and.for liquidated damages for delay as fixed in the Tender, 
until such reasonable time a3 may be required for the
final completion of the Work, or if liquidated damages
are not so fixed, any actual damages occassioned by such delay, If the Contractor’s right to proceed is to be forfeited the Employer, the Sureties (if engaged in the work) or any subsequent Confracter, may take, possession of end utilise in completeing the Work such materi <1 a, appliance and plant intended to form or forming part-of the permanent works.
b)   If the Employer does not subject to forfiture the right
of the Contracter to proceed as provided in paragraph (a) hereof, the Contractor shall continue the Work,, in which event he and his surities shall be liable to the Employer in the amount set forth in the Tender for fixed, agreed and liquidated damages for each oalender day of delay until the work is completed or aocepted, or if liquidated damages are not so fixed any actual damages occasioned 
by such delay.

o) The right of the Contractor to proceed shall not be

shall he be charged liquidated on actual dtumages, as provided in paragraph (b) hereof because of any delays
in the completion of the Works due to unforsesable
causes beyond the control and without the fail! t or negligence of the Contractor, including but zlot
restricted to, acts of God, or of the public enemy, 
acts of the Government in its sovereign capacity, acts
of another Contractor in the performance of a contract
with the Employer, acts of the Employer or the Engineer fires, floods, epedemics, quarantine restrictions, 
strikes, freight embaragoes and whether conditions unsuitable fox  the execution of the Works, or delays
of sub-contracters or suppliers due to such causes; providing that the Contractor shall within (10) days
from the begining of such delay, unless the Engineer
shall grant a further period of time prior to the date
of final settlement of the contract, notify the Engineer
in writing of the causes of delay. The Engineer shklj ascertain the facts and the extent of the ddlay end 
duly extend the time for completing the Works when 
in his judgement the state of the fact justify such 
an extension.
d) If the Employer does not terminate the right of the Contractor to proceed as provided in paragraph (a) hereof the Contractor shall continue the work, in which event he and his sureties shall be liable to the Employer in the amount set forth in the Tender for fixed, agreed and liquidated damages for each calendar day of delay until the work is completed or accepted, or if liquidated damages are not so fixed, any actual damages occasioned

by such delay.

■e) The right of the Contractor to proceed shall not be terminated, as p: cvided in paragraph (a) hereof, nor shall the Contractor be charged liquidated on actual damages, as provided in paragraph (b) hereof because of any delays in the completion of the work due to unforeseeable causes beyond the control and without the fault or negligence of the Contractor, including but not restriceted to, acts of God, or of the public enemy, acts of the Government in 
its sovereign capacity, acts of another contractor in the performance of a contract with the Employer, tires, iloods epidemics, quarantine restrictions, strikes, freight embargoes, and. unusually severe weather, or delays of sub contractors or suppliers due to such causes; provided that the Contractor shall within ten (10) days from the beginning of such delay, unless the Engineer shall grant
a further period of time prior to the date of final settlement of the contract, notify the Engineer in writing of the causes of the delay. The Engineer shall ascertain the facts and the extent of the delay and extend the time for completing the work when in his judgement the state of the facts justify such an extension and his findings thereon shall be final and conclusive on the parties hereto, subject only to appeal as provided in Clause
5T hereof. In consideration of the .provisions of this Clause 5, the Contractor hereby waives all claims for damages due to delays caused by the Employer.
6. VALUATION AT DATE OF FOREFEITURE
The Engineer shall as soon as may be practicable after
any such forfeiture fix and determine after reference
to the parties or after such investigation or enquiries

i)      The amounts payable in respect of any preleminary items so far as the work or service comprised therein has been carried out or performed and a proper preportion as certified by the Engineer of any such 
items in which the w-.rk or service comprised therein has been partially carried out or performed.
ii)       The cost of materials or goods reasonably ordered for the Works or Temporary Works which shall have been delivered to the Contractor or of which the Contractor is legally liable to accept delivery

Provided     always     that,     against     any     payment     due     from     the Employer     under     this     paragraph,     the     Employer     shall     be entitled     to     be     credited     with     any     outstanding     ba~|     -ppp     due from    the    Contractor    for    advances    in    respect    of    p’l    ant,    and materials     and     any     sum     previously     paid     by     the     Employer     to the Contractor in respect of the execution of the Works.
9. PAY1EKT TH THE EVENT OP FRUSTRATION
In the event of the Contract being frustrated whether by 
war or otherwise howsoever the sum payable by the Employer to the Contractor in respect of the work executed shall be
the same as that which would have been payable under Clause 8 hereof if the Contract had been terminated under the
provisions of Clause 8 hereof.

P4YHEMTS TO COWTRACTOR
a)  The Employer shall pay to the Contractor _ 30_%
of the estimated Contract Price within 2! days
after the signing of the Contract. The Advance thus
paid to the Contractor shall be deducted at the rate
of 2^0          % from each payment due to the Contractor after completion by the Contractor of 25 % of the
works.
b)   Unless otherwise provided in the Special conditions, payments to the Contractor shall be made with in 30 
days by the Employer upon submission by the Contractor, after the end of each month, <o copies of a statement showing the estimated Contract value of che Work executed up to the end of the month including materials delivered 
on Site and any preparatory Works, and approval by the Engineer. The statement submitted by the Contractor showing the estimated Contract value of the Work executed including materials delivered on Site and any preparatory works done shall shew the amount due. the total of all previous payments and the percentage of completion as
of the dates of .the estimate.
c)  In making partial payments, there shall be retained ten per cent (10%) on the estimated amount until provisional acceptance of all work covered by this contract, provided however, that the Engineer at any time after fifty per
cent (50%) of the work has been completed, if lie finds that satisfactory progress is being made, may certify any of the remaining partial payments in full; and provided further that on provisional acceptance of each 
separate building work or other division of the contract on which the price is stated separately in the contract, payment r.iay be made in full, including retained per
centage thereon, less authorised deductions; and provid ed furhter, that at the discretion of the Engineer, payment of a portion of the retained percentage m.-.y be
made before provisional acceptance, provided the
Contract      is      substantially      completed,      and      the      work to use by the Employer,14
d) All materials and works covered by partial payments made
shall, thereupon, become the sole prop
the
Employer, but this provision shall not be construed 
as relieving the Contractor from the solo responsibility for all materials and works upon which payments have
been made or the restoration of any damaged works, or
as a waiver of the right of the Employer to require
fulfillment of all the terms of the Contract.
e)        Upon completion and acceptance of all work required 
hereunder the amount due to the Contractor under this
Contract will be paid upon the presentation of a
properly executed and duly certified voucher therefor, 
after the Contractor shall have furnished the Employer
with a release of all claims against the Employer arising under and by virtue of this Contract, other than such 
claims, if any, as may be specifically excepted by the
Contractor from the operation of the release in stated amounts to be set forth therein. If the Contractor’s
claim to amounts payable under the contract has been assigned with the approval of the Employer in writing, a release may also be required of the assignee at the
option of the Employer.
1. CONDITIONS AT SITE OR BUILDING
The Contractor shall be responsible for having ascertained, pertinent local conditions readily determind by inspection and inquiry, such as the location, accessibility and general
character of the site or building, labour conditions, the
character and extent of existing works within or adjacent
thereto, and any other works being performed thereon at
the time of the submission of his Tender.

12.      WAYLEAVES
The Employer shall legally acquire all right of way required, 
by the Contractor in connection with access to the Site# 
If the Conti'actor suffers delay or incurs expense from
failure on the part of the Eknployer to legally acquire such 
right of way, the Engineer shall grant an extension of time
for the completion of the Works and certify such sum as are required to cover the expenses incurred, which sum shall be
paid by the Employer.
13.   MATERIALS AND WORKMANSHIP
Unless otherwise specifically provided for in the specifica
tions, all equipment, materials and articles incorporated 
in the work, covered by this Contract are to be new and of
the most suitable grade of their respective kinds for the
purpose, and all workmanship shall be first class. Where equipment, materials or articles are referred to in the specifications as "equal to" any particular standard, the Engineer shall decide the question of suitablility. The Contractor shall furnish to the Engineer, for his approval, 
the name of the manufacturer of machinery, mechanical and other equipment which be contemplates incorporating in the work, together with their performance capacities and other pertinent information. When required by the Specifications, 
or when called for by the Engineer, the Contractor shall furnish to the Engineer for approval, full information concerning the materials or articles which he contemplates incorporating in the work. Samples of materials shall be submitted for approval when so directed. Machinery, equipment, materials and articles installed or used whithout such approval shall be at the risk of subsequent rejection. 
The Engineer may in writing require the Contractor to remove from the work such employees as the Engineer deems incompetent, careless, insubordinate, or otherwise objection able, or whose continued employment on the work is deemed by the Engineer to be contrary to the interest of the . 
project.

14.     ACCESS TO THE WORK
The employer and the Engineer and their Representatives
shall have access at all times to the project for inspection 
of the work. The Contractor shall provide proper facilities
for such access and inspection.
15- INSPECTION
a)        Execept as otherwise provided in paragraph (d) hereof, all materials and workmanship, if not otherwise des ignated by the Specifications, shall be subject, ^o inspection, examination and test by the Engineer at any and all times during manufacture and/or where construction is carried out. The Engineer shall have the right to 
reject defective materials and workmanship or require
its correction. Rejected workmanship shall be satisfac torily corrected, and rejected materials shall be satisfacrorily replaced with proper materials without charge there©?- and the Contractor shall promptly segregate and remove the rejected materials from the
site. If the Contractor fails to proceed at once with 
the replacement of rejected materials and/or the correc tion of defective workmanship, the Employer may, be contract or otherwise, replace such materials and/or correct such workmanship and charge the cost thereof
to the Contractor, or may terminate the right of the Contractor to proceed as provided in Clause 5 above, the Contractor and surety being liable for any damage to the same extent as provided in said clauses 5 for termination thereunder; provided, however, that if any part of the work as installed be at variance with the contract requirements, the Engineer may, if he finds it to be in the Employer’s interest, allow any part of
such work to remain in place, subject to a proper adjustment in the Contract price.

b)   The Contractor shall furnish promptly, without additi.nal charge, all reasonable facilities, labour and materials necessary for the safe and convenient inspection and testing that may be required by the Engineer. All inspections and tests by the Engineer shall be performed 
in such manner as not to delay the work unreasonably. Special, full-size and performance tests shall be as described in the Specifications. The Contractor shall be charged with any additional cost of inspection "when materials and workmanship are not ready et the t? me inspection is requested by the Engineer.
c)   Should it be considered necessary or advisable bj, the Engineer at any time before final acceptance of he
entire work to make an examination of work already completed, by removing or tearing out same,, the Contractor shall on request, promptly furnish all necessary facilities labour and materials. If such work is found to be
defective or not to conform in any material respect, due
to fault of the Contractor or his Sub-Contractors, he
shall defray all the expenses of such examination and of satisfactory reconstruction. If, however, such work is found to meet the requirements of the Contract, the
actual direct cost of labour and materials necessarily involved in the examination and replacement, plus fifteen percent (15%), shall be paid to the Contractor and he shall, in addition, if completion of the work has been delayed thereby, be granted a suitable extension of time on account of the additional work involved.
d)        Inspection of materials and finished articles to be incorporated in the work at the Site shall be made at the place of production, manufacture or shipment, only when shop or mill inspection is required by the
Specifications, and such inspection and written or other formal acceptance, unless otherwise stated in the Specifications, shall be final, except as regards latent defects, departure from specific requirements of the contract, damage or loss in transit, fraud or <such gross mistaken as maount to fraud.

Subject to the requirements contained in the preceding sentence, the inspection of materials and workmanship 
for final acceptance as a whole or in part, shall be. 
made at the Site. Nothing contained in this paragraph (d) shall in any way restrict the Dnployer’s rights under any warranty or guarantee.
e)The Contractor shall give the Engineer at least ten (10)
days advance notice of the date on which inspections or
tests are requested by the Contractor for acceptance of
the work for any other purpose. An endorsement by the Engineer's Representative at the Site shall be attached 
to this notice which shall not relieve the Contractor of
his responsibilities in the matter. Inspection and tests
will be made within ten (10) days from the date specified 
in the aforesaid advance notice.
16.      SUPERVISION
a)        The authorised representative of the Bnployer, as to 
the proper interpretation of the Drawings and specifications, is the Engineer. Nothing shall excuse the Contractor
from proceeding with the work in accordance with the determination of the Engineer as to the interpretation 
of the Drawings and Specification.
b)   All work Bhall be done under the supervision of the Engineer.
c)   The Engineer has no authority to alter the terms of
the Conditions of the Contract without written authority from the Employer.
17.  SUPERINTENDENCE BY CONTRACTOR
The Contractor shall give his personal supervision to the work or have a competent foreman or superintendent, satisfactory to the Engineer, on the work at all times during progress, with authority to act for him. /•19
18 * WORK TO BE DOB BY CONTR/ CTOR
The Contractor shall exec ute on' the Site and with his own organization work equivalent to at least tewelve percent
(12%) of the total amount of the Contract Price. The cost
of materials installed by skilled and unskilled labour
carried on the Contractor’s own payroll may be included 
in the twelve percent.
19.    BUILDING CODES, ExC.
The Contractor shall comply with all building ordinances, codes and regulations.
20.     DAMAGE TO PERSONS AND PROPERTY
The Contractor shall (except if and so far ac the
Specification provides otherwise) indemnify and keen in demnified the Employer against all losses and claims for injuries or damage to any person or any property whatsoever (other than surface or other damage to land or crops being or the Site suffered by occupiers) which may arise out of
or in consequence of all claims, demands, proceedings, damages, costs, charges and expenses whatsoever in respect of or in relation thereto, provided, always that noting 
herein contained shall be deemed to render the Contractor liable for or in respect of or to indemnify the Employer against any compensation or damages for or with respect to:-
a) The permanent use or occupation of land by the Works or any part thereof or (save as hereinafter provided) surface or other damage as aforesaid.
b)   The right of the Employer to Construct the Works or any part thereof on, over, under, in or through any land.
c)   Interference whether temporary or permanent with any right- of light, air, way or water or other easement
or quasi easement which in the unavoidable result of the construction of the Works in accordance with/ the Contract.

d)        Injuries or damage to persons or property resulting from any act or neglect done or committed during the currency of the Contract by the Employer, his agents servants or other contractors (not being employed by 
the Contractor) of for or in respect of any claims, demands, proceedings, damages, costs, charges and. expenses in respect thereof or in relation thereto*
Provided further that for the purposes of this Clause the experession ''the site" shall be deemed to be limited to the
area defined in the specification or shown on the drawings
in which land and crops will be disturbed or damaged as a consequence of the carrying out of the Works.
21 . INDEMNITY BY EMPLOYER
The Employer will save harmless and indemnify the Contractor from and. against all claims, demands, proceedings, damages, costs, charges and expenses in respect of the matters
referred in Clause 20 hereabove.
22. TAXES
The Contractor shall, without additional expense to the Employer, pay all applicable taxes, except land taxes and assessments on real property comprising the Site of the project.
23. YARD STORAGE
The Contractor shall, as necessary, build at his own expense on the Site or in the vicinity thereof, temporary warehouses easily accessible for inspection by the Engineer, for the proper storage of materials.

SCAFFOLDINGS and plant
The Contractor shall, as necessary, provide all required scaffoldings, hoists, ladders, staging tackles, tarpaulins, 
tools and other plant, mechanical or otherwise, and allow
for their operating, shifting and maintenance by all labour
as necessary,
. TEMPORARY DRAINAGE
■ The Contractor shqll be responsible for providing at his
own expense, any temporary drainage that may become
necessary during the course of the work and for pumping 
out all trenches and pier holes and for making good same,
>. WORKYARD OFFICE
The Contractor shall, as may be necessary, erect on the site
and. remove upon completion of the work, separate site offices, the size of which are to be agreed by the Engineer’s Representative, complete with the schedule of furniture listed 
.in the Specification for both the Contractor and the Engi mpp-t » Representative, including the installation of a telephone, if
the location of the Site so permits.
27. SITE LATERINES
The Contractor shall, as may be necessary, provide and erect on the Site or in the vicinity thereof, in positions which will not cause annoyance to anyone in the neighbourhood, workyard latrines for workmen and site staff, mninta-jn the
same in a clean and sanitary condition, and disinfect the , ground periodically and on completion of the work. «22

The Contractor shall, as may be necessary, be responsible
for the provision of water for the work (including that for
sub-contractors) with all temporary wiring and me vers; and 
later, adapt ond maintain same and pay charges in connection 
therewith,

The Contractor shall, as may be necessary and allowed by 
the location of the Site, provide lighting and electrical
power for the work (including that for sub—contractors)
with all temporary wiring and meters; and alter, adapt
and maintain same and pay charges in connection therewith.
30.     BARRICADES AMD SCREENS
The Contractor shall, as may be necessary, provide all
barricades, gantries, screens, etc. for the protection of
labourers, adjoining property and the public, and shall
alter, adapt and maintain same us necessary.
31.  HEAT
The Contractor shall provide sufficient heat as follows
a)   As necessary to protect all works, materials and 
equipment against damage from dampness and cold.
b)       At    all    times    during    the    placing,    setting    and    curing    of concrete,     to     ensure     the     heating     of     the     spaces     involved to not less than 10°C.
c)   From the beginning of the application of plaster and during the setting and curing period, to produce a temperature of not less than 10°C. and
d)   For a period of ten days prior to the placing of interior woodfinish and thorughout the placing of this and other interior finishing, varnishing, paint-, ing, etc. and until the completion of the building(s), to produce u temperature of not less than 20°C. y23
patent indemnity
Except- as otherwise provided, the Contractor agrees ;o indemnify the Employer and his officers, agents and employees against liability costs and expenses for infringement upon any Letters Patent arising out of the performance of this contract or out of the use or disposal by or for the account of the Employer of supplies furnished or construction work performed hereunder.
. OTHER CONTRACTS
The Employer may undertake or award other contracts for additional work and the Contractor shall fully co-opex’ate
with such other contractors and Employer’s workmen and carefully fit his own work to such additional work as may be directed by the Engineer. The Contractor shall not commit
or permit any act which will interfere with the performance
of any other contractor or by workmen of the Employer.
. MUTUAL RESPONSIBILITY OR CONTRACTORS
If through acts of neglect on the'part of the Contractor, 
any other contractor or any sub-contractor, shall suffer
loss or damage on the work, the Contractor agrees to settle with such other contractor or sub-contractor by agreement or arbitration if such other contractor or sub-Contractor will
so settle. If such other contractor or sub-contractor
shall make any claim against the Employer on account of any damage alleged to have been sustained, the Employer shall notify the Contractor, who shall indemnify and save the Employer harmless against any such claim,
35  • SUB-CONTRACTING
Q ) Nothing contained in the contract shall be construed as creating any contractual relationship between any sub-contractor and the Dnployer. The divisions or sections
of the Specifications are not intended to control the
Contractor in dividing the work among Sub-Contractors,
or to limit the work performed by any trade.
The Contractor shall be responsible to the Employer for
acts and ommissions of his own employees, and of Sub
contractors and their employees. He shall also be
responsible for the co-ordination of the work of the
trades, Sub-Contractors and material.
The Contractor shall, without additional expense
(except those claimable under this Contract) to the
Employer, employ Sub-Contractors where required.
The Employer, Engineer, or their representatives will not
undertake to settle any differences between the Contractor
and his Sub-Contractors, or between sub-Contractors.
CONSTRUCTION SCHEDULE AND CONTRACT PRICE BREAKDOWN Immidiately after the signing of the Contract and before
the first partial payment is made, the Contractor shall
deliver to the Engineer a construction progress schedule
in a form satisfactory to the Engineer, showing the proposed dates of commencement and completion of each of the various sub-divisions of work required under the Contract Documents and the anticipated amount of each monthly payment that will become due to the Contractor in accordance with the progress schedule. In addition and at the same time the Contractor shall also submit to the Engineer a detailed estimate giving complete breakdown of the Contract Price.)7 • 1WASURES
All dimensions shown of existing work and all dimensions required for work that is to connect with work now in place, shall be ve ified by the Contractor by actual measurement of the existing work, Any discrepancies between the drawings
and Specifications and the existing conditions shall be
referred to the Engineer for adjustment before any work affected thereby has been performed.
38. MOIRTENTS AMD BENCH MARKS
a)   The Engineer will establish sufih general reference points as will enable the Contractor to proceed with the work. 
If the Contractor finds that any previously established reference points have been destroyed or displaced, he
shall promptly notify the Engineer.
b)   The Contractor shall protect and preserve the established bench marks and monuments and shall make no changes in. locations without the written approval of the Engineer. Any of them which may be lost or destroyed or which require shifting because of necessary changes in grades
or locations shall, subject to prior approval by the Engineer, be replaced and accurately located by the Contractor,
c)        The Contractor shall provide competent engineering services as necessary to execute the work in accordance with the Contract requirements. He shall verify the figures shown on the survey and approach drawings before undertaking any construction work and shall be responsible for the accuracy of the finished work.

39.         STANDARD REFERENCES
(a)          Any materials, equipment or workmanship specified by reference to the number, symbol or title of any specific standard shall comply with the latest edition or revision thereof and any amendment or supplement thereto in effect on the date of the invitation for Tenders except as limited to type, class or
grade , or modified in the specification.
(b)
Standards referred to in the Specifications, except as
modified, shall have full force and effect as though printed 
in the Specification.
(c)
Reference in the Specifications to any artacje. device,
product, materials, fixture, form or type of contruction
by name, make, or catalogue number, shall be interpreted as
establishing a standard of quanlity, and not as limiting com- etition. The Contractor may make substitution equal to the items specified, if approved in advance by the Engineer in writing.
40. DRAWINGS
(a)          The general character and scope of the work, are shown by the drawings listed in the Specification.
(b)           In the case of differences between small and large scale drawings shall govern. Schedules on drawings shall take precedence over any conflicting notations on the drawings. On any of the drawings where a portion of the work is drawn out and the remainder is shown in outline, the parts drawn out and remainder is shown in outline, the parts drawn out shall apply also to all other like portions of the work.27
c)        Where the word "similar" occurs on drawings, it shall
have a general meaning and not be interpreted a3 being identical, and all details shall be worked out in 
relation to their location and their connection with 
other parts of the work.
41.     STANDARD DETAILS
Standard Details, when available, may be listed on drawings
and accompany the Specification. Their application is made
specific by notation on drawings or by references elswhere
in the Specifications. Where the notes on drawings indicate modifications of the details listed, such modifications shall
be made.
42.    SHOP DRAWINGS
a)        The Contractor 3'nall submit for the approval of the Engineer, shop drawings, setting drawings and schedules, required by the Specifications or requested by the
Engineer. No work shall be fabricated, save at the
Contractor’s risk, until such approval has been received*. Drawings and Schedules shall be delivered to the Engineer,
b)        Drawings and schedules shall be checked and co-ordinated with the work of any other trader involved, before they 
are submitted for the approval of the Engineer and shall
bear the Contractor’s stamp of approval as evidence of
such checking and co-ordination. Drawings or schedules submitted without this stamp of approval will be
returned to the Contractor for re-submission.
c)        Drawings and schedules shall be submitted in quarduplica- te (unless otherwise specified), accompained by a letter
of transmission in triplicate. The letter shall include
a list of the numbers and dates of the individual
drawings submitted. Drawings shall be complete, bound in sets, and shall bear:                                                       a.1.

d)   The Contractor shall submit all drawings and schedules
sufficiently in advance of construction requirements to 
allow ample time for checking, re-submitting and
re-checking.
e)   The appro/al of drawings and schedules will be general, 
but approval shall not be construed:
1.   as permitting any departure from the Contract
requirements;
2.   as relieving_the Contractor of the responsibility 
for any errors, including details, dimensions, 
materials, etc.;
3.        as      approving      departures      from      full-size      details furnished      by      the      Engineer,      except      as      otherwise provided herein.
f)         If drawings show variations from the Contract requirements because of standard shop practice or for other reasons
the Contractor shall describe such variations in his
letter of transmission. If 'acceptable, the Engineer
may approve any or all such variations, subject to a
proper adjustment in the Contract. If the Contractor
fails to describe such variations, he shall not be relieved of the responsibility for executing the work in accordance with the Contract, even though such drawings have been approved.
g)        If the drawings end schedules as submitted indicate a departure from the Contract requirements, which the Engineer finds to be in the interest of the Employer and to be so minor as not to involve a change in the Contract Price or time for performance, the Engineer may approve
the drawings.

43.    SAMPLES.
a)   After the award of the Contract, the Contractor shall furnish for the approval of the Engineer, samples
required by the specifications or requested by the Engineer. Samples shall be delivered to the Engineer unless otherwise directed. The Contractor shall prepay 
all shipping charges on smaples. Materials or equipment for which samples are required shall not be used in
the work until approved in writing by the Engineer, 
save only at the Contractor’s risk and expense.
b)   Each sample shall have a label indicating
1.     Name of the project.
2.     Name of the Contractor.
3.     Material or equipment represented.
4.     place of origin.
5.     Name of producer and brand (in any).
G. Location in the project.
Samples of finished materials shall have additional markings that will identify them under the finish, schedules,
c)        The Contractor shall mail under separate cover a letter in triplicate submitting each shipment of samples containing the information required in (b) above. He shall enclose a copy of this letter with the shipment
and send a copy to the engineer’s Representative on the project. Approval of a sample shall be only for
the characteristics or use named in such approval and shall not be construed to change or modify any Contract requirement. Before submitting samples, the Contractor shall assure himself that the materials or equipment will be available in the quantities required in the Project, because no change or subsitution will be
permitted after a sample has been approved.30
d)        Approved     samples     not     destroyed     in     testing     will     be     sent
to       the       Engircer’s       Representative       at       the       project.       Approved samples     of     hardware     in     good     condition     will     be     marked     for identification      and      may      be      used      in      the      work.      Materials
and  equipment incorporated  in  the work  shall match  tile approved  samples.  Samples not destroyed  in  testing  or not approved  will be returned  to  the Contractor at his expense if so requested at the time of submission.
e)   Failure of any materials to pass the specified tests will
be sufficient cause for refusal to consider under this
Contract any further samples of the same brand or mark
of that material, The Engineer reserves the right to 
disapprove any materials or equipment which previously 
has proved unsatisfactory in service.
f)    Samples of various materials or equipment delivered on the Site in place may be taken by the Engineer's Representative for testing. Samples’failing to meet the Contract
requirements will automatically void previous approvals of the items tested. The Contractor shall replace such 
materials or equipment to meet Contract requirements, or there shall be a proper adjustment of the Contract price
as determined by the Engineer.
44.      CLIMATIC CONDITIONS
When so ordered by the Engineer, the Contractor shall
suspend any work that may be subjected to damage by climatic conditions.
45.      CONDITIONS OF EMPLOYMENT
a)  All mechanics and labourers employed on working directly upon the site will be paid unconditionally and not less often than once a fortnight, end without subsequent deduction or rebate on any account the full amounts
due at time of payment, computed at wage rates not less31
than those conditioned in the wage schedule as laid down 
by law, and a copy of the wage schedule shall be kept
posted by the Contractor at the Site in a prominent place
where it can easily be seen by the workers.
b)   In the event it is found by the Employer that any labourer
or mechanic employed by the Contractor or any sub—contract or directly on the Site of the work covered by this
Contract has been or is being paid at a rate of wages less
than the rate of wages required by paragraph (a) of this
Clause, the Employer may:
1.         by written notice to che prime Contractor terminate hi3 right to proceed with the work or such p rt of
the work as to which there has been a failure to pay the 3aid required wages,
and 2. prosecute the work to completion by contract or otherwise, whereupon such Contractor and his sureties shall be liable to the Employer for any excess costs occasioned to the Employer thereby.
46. OVEETU'.IE COMPENSATION
No labourer or mechanic doing any part of the work con templated by this Contract, in the employ of the Contractor or any sub-Contractor for any part of the said work con templated shall be required or permitted to work more.than ten (10) hours in any one calendar day upon such work, except upon the condition that compensation is paid to such labourer of mechanic in accordance with the provision of thi3 Clause. The wages of every labourer or mechanic employed by the Contractor or any sub-Contractor engaged in the performance of this contract shall be computed on 
a basic day rate of ten hours per day and work in c-xccss or ten hours per day at not less than one and one-half times the basic rate of pay. Por each violation or32
the requirement of this Clause, a penalty of five dollars
shall be imposed for each labourer or mechanic for every calendar day in which such employee is required or
permitted to labour more than ton hours upon said work without receiving compensation computed in accordance
with this Clause, and all penalties thus imposed shall
be withheld for the use and benefit of the Employer.
47.      PAYROLL RECORDS AND PAYROLLS
a) Payroll records will be maintained during the course of
the work and preserved for a period of three years
thereafter for all labourers and mechanics working at
the Site. Such records will contain the name and address
or each such employee, this correct classification rate
of pay, daily and weekly number of hours worked, deduct ions made and actual, wages paid.' The Contractor will
make his employment records available for inspection 
by authorised representatives of the Government and 
will permit such representatives to interview employees during working hours on thq job.
WITHHOLDING OF FUNDS TO ASSURE WAGE PAYMENT There may be withheld from the Contractor so much of the accrued payments of advances as may be considered necessary to pay labourers and mechanics employed by the Contractor
or any Sub-Contractor the full amount of wages required by this contract. In the event of failure to pay any labourer
or mechanic all or part of the wages required by the Contract, the Employer may take such action as may be necessary to cause the suspension, until such violations
have ceasgd, of any further payment, advance,   or guarantee
of funds to or for the Prime Contractor,

49.     SUBCONTRACTS TERMINATION
The Contractor agrees to insert Clauses 45 through. 49 here
of in all sub-contracts and further agrees that a breach 
of any of the requirements of these Clauses may be grounds for termination of the Contract. The terra "Contractor”
as used in such Clauses in any sub—Contract shall be deemea to refer to the Sub-Contractor except in the phrase "Prime Contractor".
50.     PRIME CONTRACTOR
The phrase "Prime Contractor" as used in Clause 47 and 43 above shall be deemed to mean the Contractor under this agreement.
51.    . AC CIDENT PREVENTION
Precautions shall be exercised at all times for the protection of persons (including employees and property)
and hazardous conditions shall be guarded against or eliminated.
52      REPORTS
The Contractor and, through him, each of his sub-Contractors shall submit to the Engineer progress schedules and reports
as the Engineer may request concerning work performed or to be performed under the Contract,
53.     ASSIGNMENTS
The Contractor shall not assign the whole or any part of this Contract, he shall not assign any monies duo or to become due thereunder without written oonsent of the
Employer.

54,     NOTICE Aiu SERVICE.THEREOF
Any notice to the Contractor from the Employer or the
Engin .’er relative to any part of this Contract shall be
made in writing by the Engineer and considered delivered 
and the service thereof completed when the said notice is
■posted by registered mail to the said Contractor at his
last given address, or delivered in person to said 
Contractor or his authorised representative on the work.
55.     GUARANTEE OF ROOFING AND MECHANICAL AND ELECTRICAL WORKS a)   All roofing and mechanical and electrical works shall be
guLranteed by the Contractor to be in accordance with 
the Contract requirements and free from defective or inferior materials, equipment or workmanship, for a
period of one year from the date of final settlement of
the Contract or from an earlier date determined by the Eknployer.
b)   If, within any guarantee period, repairs or changea are required in connection with guaranteed works, which in the opinion of the Engineer, are rendered necessary as
the result of the use of materials, equipment or workmanship which are inferior, defective, or not in accordance with the terms of the Contract, the Contractor shall promptly upon receipt of notice from the Engineer and without expense to the Employer:-
1.     place in satisfactory condition, in every particular, all of such guaranteed work,
2,     make good all damage to the equipment, the site, the building(s) or contents thereof which in the opinion of the Engineer, is the result of the use
of materials, equipment or workmanship which are inferior, defective or not conforming with the
terms of the Contract,

and 3. make good any work or material or equipment and contents of the said building(s) or site distrubea
in fulfilling any such guarantee.
c)
In any case, where in fulfilling the requirements of the
Contract or of any guarantee embraced in or required thereby, the Contractor disturbs any work guaranteed under
another contract, he shall restore such disturbed work 
to a condition satisfactory to the employer and guarantee
such restoration to the same extent as it was guranteed under such other contract.
d)   If the Contractor, after notice, fails to proceed promptly 
to comply with the terms of the guarantee, the Employer
may have the defects corrected and the Contractor and his
sureties shall be liable for all expense incurred.
e)   All special guarantees applicable to definite parts of
the work that may be stipulated in the Specification or
other documents forming a part of the Contract, shall
be subject to the terms of this paragraph during the
first year of the lift of such special guarantee.
56.
DEBRIS AHI) CLEANING
a)   The Contractor shall, during the progress of the work, remove and dispose of the resultant dirt and debris and keep the Site clean.
b)   Upon completion of the works, the Contractor shall
remove all construction equipment and surplus materials
and leave the Site in a clean condition to the
satisfaction of the Engineer's Representative.Ill

Clause 64 INSURANCE OF WORKS
Without limiting his obligations and responsiblilities
under Clauses 20 and 34 hereof the Contractor shall insure

terms of the Contract and in such manner that the Employer
and Contractor are covered during the period of Defects Liability period for loss damage arising from a cause

contained shall render the Contractor liable to insure
against the necessity for the repair or reconstruction • 
of any work constructed with materials or workmanship not
in accordance with the requirements of the Contract.
Clause 66 THIRD PARTY INSURANCE
a)    Before commencing the execution of the '.forks the
Contractor (but without limiting his obligations and 
responsibilities under clause £0 hereof) shall'insure
against any damage loss or injury which may occur to 
any property (including that of the Employer) or to 
any person (including that of the Employees of the
Employer)by or arising out of the execution of the
Works or Temporary Works or in the Carrying out of the
Contract ether wise than due to the matters referred 
to in the provise to Clause 15 hereof.
b)    The Contractor shall insure against- such liability 
with an insurer approved by the Employer (which 
approval shall not be unrec.sonably vri.thh.eld).
The Contractor shall, when required, produce to the
Engineer or the Engineer’s Representative such 
policy of insurance and the receipt for payment of
the current premium.
Clause 67 INSURANCE AGAINST ACCIDENT OR INJURY TO V'OldglEM a) The Employer shall not be liable for or \n respect
of any damages or compensation payable at- law in respect or in consequence of any accident or injury to any workmen or other person in the employment; of the Contractor or any sub—contractor save and excepti an accident, or injury resul ting from an; act or defaul u of the (Employer his agents or servants and the Contract
or shall indemnify and keep indemnified the Employer against all such damages and compensation (save and 
except as aforesaid) and against all claims demands proceedings costs charges and expenses whatsoever in 
respect thereof or in relation thereto.
b) The Contractor shall insure against suca liability 
with an insurer approved by the Employer (which 
approval shell not be unreasonably withheld) and shall continue such insurance during the whole of the time
that any persons are employed by him on the '.7orks
and shall when required produce to the Engineer or
the Engineer's Representative such policy of insurance
and the receipt for payment of the current premiums. Provided always that in respect of any persons employed by any sub-contractor the Contractor’s obligation to 
insure as aforesaid under this sub—clause shall be
satisfied if the sub-contractor shall have insured 
against the liability in respect of such persons in 
such manner that the Employer is indemnified under
the policy but the Contractor shall require such 
Sub-Contractor to produce to the Engineer or the
Engineer's Representative when required such policy 
of insurance and the receipt for payment of the
current premium.
Clause 68 REMEDY ON CONTRACTORS FAILURE TO INSURE If the Contractor shall fail to affect and keep in force
the insurances referred to in Clauses 65 , 6(?> and 6? hereof or any other insurance which he may be required 
to effect under the terms of the Contract then and in 
any such case the Eknployer may effect and keep in force any such insurance and pay such premium or premiums■nsmay be necessary for that purpose and from time to time deduct the amount so paid by the linployer as aforesaid, from any monies due or which may become due to the
